Safety First, Speech Second: Child Protection and the Politics of Control in the Digital Age

​It was one of those muggy, pollen-choked mornings in July, half the nation hayfevered into a stupor, the other half still convinced the internet was a threat greater than inflation. I was parked behind a crumbling Tesco Express, scrolling through the feed on my knackered old phone 

​"You must verify your age to view this content."
​Not explicit material. Not even a swear word. Just a meme, Churchill with a pigeon on his head and the caption "Still better than lockdown." Now age-restricted. Welcome to the United Kingdom in 2025, where even jokes might need ID.

The Online Safety Act 2023 is now law, and it's changing how we communicate, share, and interact online. It has been praised for its ambition to create safer digital spaces, particularly for children, but it also raises serious questions about the balance between protection and freedom.

🎯 What the Act Is Supposed to DoPassed in October 2023, the Act introduces a new statutory duty of care for online platforms, especially those offering "user-to-user" services, such as social media and messaging apps.

The goal? To reduce exposure to:
  • Illegal content (e.g., terrorism, child sexual abuse, fraud),
  • "Priority content" is harmful to children (e.g., material related to self-harm or suicide), and
  • Cyberbullying and online abuse.

As of 25 July 2025, platforms must implement robust age verification systems for specific types of content and conduct regular risk assessments. They must also respond quickly to flagged posts and provide tools for user redress.

The regulator Ofcom has been given powers to:
  • Issue fines up to £18 million or 10% of global turnover,
  • Block non-compliant services in the UK,
  • Enforce criminal penalties for serious harms such as cyber-flashing or incitement to self-harm.

Balancing Safety with Free Expression

While the intention to protect vulnerable users is widely supported, critics, including civil liberties organisations, technologists, and some political commentators, have expressed concern about how broad and subjective some parts of the Act may be in practice.

Terms such as "harmful content," while now more narrowly defined than in earlier drafts, remain open to interpretation. There's a risk that platforms, in seeking to avoid penalties, will err on the side of caution and remove legal but sensitive speech, including satire, political opinion, or newsworthy but disturbing material.

The result could be a "chilling effect," where users begin self-censoring, uncertain about what's safe to post. This isn't government censorship in the traditional sense, it's regulation driven by a risk-averse approach. Platforms, faced with financial jeopardy, may restrict content more aggressively than the law requires.

The Politics of Child Protection

What makes this legislation particularly complex is its moral framing. Because it centres on protecting children, a universally supported aim, questioning the scope or execution of the Act can be socially and politically difficult.

Civil liberties groups such as the Open Rights Group and Article 19 have argued that this environment makes it harder to have honest debates about privacy, speech, and regulation. Critics fear that the protective narrative may discourage scrutiny of overreach, especially around:

  • End-to-end encryption,
  • Age verification using biometric data,
  • And automated content moderation.

This framing is not inherently deceptive, but its rhetorical power is significant. Criticising enforcement mechanisms can be misrepresented as opposing child protection itself, which risks overshadowing legitimate debate about digital rights.

Wider Context: Accountability Gaps and Public Trust

In parallel with the online safety debate, the current UK government has faced criticism over its decision not to launch a full national inquiry into historical child exploitation cases, including grooming gang abuse across multiple towns.

Instead, it has supported region-specific inquiries. While this approach is intended to provide localised understanding, victims' advocates and some members of the public have argued that it may fail to uncover systemic patterns or hold institutions fully accountable.

In this context, some campaigners and commentators have questioned whether the focus on digital child protection has diverted attention from ongoing real-world safeguarding failures. It's important to note: the government has not explicitly positioned one in place of the other, but the contrast in scale and response has not gone unnoticed.

Who Gains?

Ofcom is now empowered to lead one of the most complex regulatory frameworks in UK digital history.

Child protection charities, who've long called for better safeguards and have welcomed the Act's intentions.

Tech companies offering age verification and moderation tools, many of whom are now seeing rising demand for compliance technology.

Who Might Lose Out?

Small and independent platforms, which may struggle to afford compliance infrastructure or legal advice.

Users are concerned about privacy, especially those who are unwilling to share their personal information to access legal content.

Campaigners, journalists, and artists whose work may challenge social norms or political narratives, material that could be flagged as "harmful," even if lawful.

Risk of Overreach

The Online Safety Act allows Ofcom to request platforms make "best endeavours" to identify illegal content even within encrypted communications. While this part of the Act is not yet enforced, and will only be activated if "technically feasible", it has drawn concern from companies such as WhatsApp, Signal, and Apple, who say it could compromise encryption.

The Act also gives the Secretary of State limited powers to influence Ofcom's regulatory codes. Though any changes must be reported to Parliament, civil liberties groups have called for clearer guardrails on political interference.

Conclusion: The Trade-Off We Must Watch

The Online Safety Act 2023 is, without question, a landmark piece of legislation, well-intentioned and capable of addressing serious harms. But like all powerful laws, it must be subject to ongoing scrutiny, especially where its effects on speech, privacy, and innovation are concerned.

If we treat online safety as a matter of debate, we risk overlooking fundamental accountability gaps, over-regulating expression, and trading freedom for optics.
